Terms & Trade Conditions
These Terms govern use of the GEKUMI website and describe the commercial framework for professional enquiries, trade-account access, RFQs, quotations and live-animal transactions where applicable. Public catalog information is not a binding offer, allocation or shipment approval.
Development-stage terms
Final legal-entity details, registered address, governing-law provision, operational payment methods and transaction-specific policies will be finalized before commercial launch.
Where a written quotation, invoice, contract or shipment-specific document conflicts with general website information, the transaction-specific document will govern to the extent stated in that document.
Acceptance of These Terms
By accessing or using this website, you agree to these Terms to the extent applicable to your use of the site. If you do not agree with these Terms, do not use the website or submit a professional trade enquiry.
Additional written terms may apply to a quotation, invoice, shipment, trade account, buyer qualification process or other specific transaction.
Professional B2B Use
GEKUMI is structured for professional live-animal trade, importers, wholesalers, breeders and other qualified business counterparties. The website is not designed as a general consumer retail storefront.
You are responsible for providing accurate information about your business identity, importer status, destination, receiving arrangements and other matters relevant to a proposed transaction.
Catalog, Availability & Public Records
Public animal records, species pages, availability pages and other catalog information may include representative or development data. Unless explicitly stated otherwise in a transaction-specific communication, public display does not constitute a commercial offer.
Availability, pricing, allocation and transaction eligibility are confirmed separately through the applicable professional trade workflow.
RFQs, Enquiries & Quotations
An RFQ, enquiry or request for information does not create an order, reserve an animal or require GEKUMI to accept a transaction.
A quotation may specify animals, quantities, prices, validity period, payment requirements, destination assumptions, shipment conditions, document requirements and other transaction-specific terms.
A quotation is subject to the terms stated in that quotation and may expire or be withdrawn before acceptance where permitted by its terms.
Trade Accounts & Buyer Qualification
Certain pricing, commercial terms, RFQ functions or allocation information may be restricted to approved professional trade users.
Submission of trade-account information does not guarantee approval. GEKUMI may request reasonable business, importer or transaction-related information before enabling trade access or proceeding with a proposed transaction.
Trade-account approval does not by itself establish import permission, destination acceptance, customs clearance or shipment approval.
Pricing, Taxes & Payment
Trade pricing may be buyer-specific and may depend on species, individual animals, quantity, destination, commercial terms, documentation, transport requirements or other transaction factors.
GEKUMI does not request payment-card details through ordinary public website contact forms. Follow only payment instructions issued through the approved transaction workflow.
Orders, Confirmation & Allocation
A transaction is not confirmed merely because an enquiry, RFQ, trade-account application or payment discussion has occurred.
The point at which an order or allocation becomes binding will be identified by the applicable quotation, invoice, written confirmation or other transaction document.
Unless expressly confirmed by GEKUMI, an animal remains unallocated.
Changes, Cancellation & Refunds
Cancellation rights, refund eligibility and charges may depend on the stage of the transaction, live-animal allocation, documentation, transport booking, regulatory preparation and other costs already incurred.
Any transaction-specific cancellation or refund terms stated in a quotation, invoice or written confirmation will take priority over general website language.
Do not assume that consumer-style return or cooling-off rights apply to professional B2B live-animal transactions.
Live Animals & Animal Welfare
Live-animal transactions require handling and shipment decisions that prioritize animal welfare, transport suitability and applicable professional requirements.
Animal-specific condition
Individual animals are living organisms. Appearance, weight, behavior, minor cosmetic characteristics and other biological attributes may vary. Representative photographs or catalog descriptions do not guarantee that every animal will be identical to another specimen or reference image.
GEKUMI may decline, delay or modify a proposed shipment where animal welfare, route suitability, weather, carrier constraints, documentation or other material conditions make shipment inappropriate.
Live Shipping, Transport & Delivery
Shipping arrangements depend on the animal, destination, route, carrier availability, documentation, entry point, weather and other transaction-specific circumstances.
Any special live-arrival assurance or shipment claim procedure applies only when expressly stated in the applicable transaction documents or a separately published policy.
Import, Destination & Regulatory Responsibility
Public compliance pages provide preparation information and review methodology. They are not legal advice, permit determinations, authority decisions or guarantees of import permission or clearance.
The proposed buyer, importer and other relevant parties remain responsible for confirming current requirements applicable to their transaction, including destination, buyer, route, entry, quarantine, customs, documentation and other regulatory conditions.
Requirements may change and should be reconfirmed before shipment.
Arrival, Inspection & Claims
Where a transaction includes specific arrival-condition, live-arrival or claim procedures, the buyer must follow the instructions and time limits stated in the applicable quotation, shipment documentation or written policy.
The buyer should inspect the shipment promptly on receipt and preserve reasonable evidence relevant to any claim, including packaging, animal condition and shipment information where applicable.
Do not dispose of relevant evidence or take action that materially prevents reasonable review of a claim before contacting GEKUMI, except where immediate animal-welfare action is reasonably necessary.
Website Information & Third-Party Resources
GEKUMI aims to maintain useful and accurate website information, but public content may be updated, corrected, replaced or withdrawn. Development content may contain representative or incomplete information.
Links to government authorities, regulators, carriers, service providers or other third-party websites are provided for reference. GEKUMI does not control third-party websites or guarantee their continued availability or accuracy.
Intellectual Property
Unless otherwise stated, website design, branding, original text, graphics, photographs, databases and other GEKUMI content are protected by applicable intellectual-property rights.
You may use public website content for ordinary internal evaluation of a potential professional relationship with GEKUMI. You may not copy, republish, scrape, reproduce, commercially exploit or misrepresent protected content except where permitted by law or expressly authorized.
Third-party trademarks, government materials and external resources remain the property of their respective owners.
Disclaimers & Limitation of Liability
To the extent permitted by applicable law, the public website is provided for informational and professional trade-preparation purposes without a guarantee that all content will always be complete, current or error-free.
Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited.
Any transaction-specific warranties, remedies, liability limits or claim procedures will be governed by the applicable quotation, invoice, agreement or other binding transaction terms.
Legal Entity, Governing Law & Disputes
The final contracting entity, registered business details, governing law and dispute-resolution provisions have not yet been frozen for the development website.
For an actual transaction, use the contracting-entity and governing-term information stated in the applicable binding transaction documents.
Changes to These Terms
GEKUMI may update these Terms as the website, business structure, trade model, legal entity, payment workflow, shipping arrangements or regulatory framework develops.
Updated Terms may be published on this page with an appropriate effective date or other notice.
